1. Acceptance of Terms

These Terms of Service (“Terms”) form a binding agreement between you and ZYNATY TECHNOLOGIES (OPC) PRIVATE LIMITED (“Zynaty,” “we,” “us,” or “our”), a One Person Company incorporated in India, with registered office at C/O Arabinda Ghosh, Ward No. 4, Master Para, Katwa, Bardhaman – 713130, West Bengal, India.

By accessing or using KidMoat (the “Service”), including the mobile application, the parent dashboard, and the kidmoat.com website, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

  • You must be at least 18 years of age (or the age of majority in your country, whichever is higher) and the parent or legal guardian of any child whose device you set up with KidMoat.
  • You confirm that you have legal authority to install software, grant permissions, and apply parental controls on the child's device.
  • If you are using the Service on behalf of a household, you represent that all co-parents who use the Service have agreed to these Terms.

3. The Service

KidMoat is a parental control application for Android devices that lets parents monitor and manage their children's device usage. Features include screen-time management, app controls, web filtering, GPS location and geofence alerts, in-app purchase warnings, and gamified healthy-habit tracking. To enforce rules in real time, KidMoat relies on Android system features including the Accessibility Service, a local on-device VPN for web filtering, and Device Administrator (uninstall protection) — all of which are explained in our Privacy Policy.

The features available to you depend on your subscription plan. We may add, modify, or discontinue features over time; if a change materially reduces functionality available to your plan, we will give you reasonable advance notice.

4. Account Registration & Co-Parent Access

  • One KidMoat account is allowed per family. Co-parents may be invited so that both guardians can monitor from their own devices.
  • You agree to provide accurate registration information and to keep it current.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account. Notify us immediately at kidmoat@gmail.com if you suspect unauthorised access.

5. Acceptable Use

KidMoat is provided strictly for monitoring children under your parental or legal guardianship. You agree that you will not:

  • Use KidMoat to monitor, surveil, track, or intercept communications of any adult without their explicit, informed consent.
  • Use KidMoat for stalking, harassment, intimidation, or any unlawful purpose.
  • Reverse-engineer, decompile, disassemble, or attempt to derive source code from the Service, except to the extent such restrictions are prohibited by applicable law.
  • Circumvent, disable, or interfere with security, authentication, or access-control features of the Service.
  • Use the Service to violate the privacy, intellectual property, or other rights of any third party, or to transmit unlawful, infringing, or harmful content.
  • Resell, sublicense, or commercially exploit the Service without our prior written consent.

We reserve the right to suspend or terminate any account used in violation of this section and to cooperate with law enforcement where misuse is suspected.

6. Subscription & Billing

Plans

  • Starter: ₹99/month (1 child device)
  • Family: ₹149/month (up to 3 child devices)
  • Family+: ₹249/month (up to 5 child devices)
  • Premium: ₹599/month (unlimited devices, priority support)

Prices are inclusive of applicable taxes unless otherwise stated.

Trial & Auto-Renewal

  • A 7-day free trial is available for new users. No payment is collected during the trial.
  • Subscriptions are billed monthly or annually, in advance. Annual billing is available at a 20% discount compared to monthly billing.
  • Subscriptions auto-renew at the end of each billing cycle at the then-current price unless cancelled before the renewal date.
  • Payments are processed exclusively through Google Play Billing. We do not receive or store your card details; your payment information is handled by Google under its own terms and privacy policy.
  • We may change subscription prices with at least 30 days' advance notice. Price changes apply at your next renewal; you may cancel before that renewal if you do not accept the new price.

7. Cancellation & Refunds

  • You may cancel your subscription at any time from the Google Play subscription page (or from the cancellation shortcut inside the KidMoat app, which links to it).
  • After cancellation, paid features remain available until the end of the current billing cycle. We do not provide partial refunds for unused portions of a billing period.
  • We offer a 7-day money-back guarantee on your first paid subscription. If you are not satisfied, write to kidmoat@gmail.com within 7 days of your first charge for a full refund.
  • Because all subscriptions are processed through Google Play Billing, refunds are also subject to Google's Play Store refund policies.

8. Permissions on the Child Device

To deliver its features, KidMoat asks the parent to grant several Android permissions on the child's device, including Location, Usage Access, Accessibility Service, Notification Access, a local on-device VPN, and Device Administrator (uninstall protection). The purpose, scope, and limits of each permission are described in our Privacy Policy.

By granting these permissions, you confirm that you are the parent or legal guardian of the child whose device you are configuring, and that you have informed the child in an age-appropriate way that their device is being managed by you. You may revoke any permission at any time through the device's Android Settings; some features will stop working until permission is restored.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect personal data. By using the Service, you acknowledge that you have read and understood the Privacy Policy and the specific disclosures it contains about sensitive permissions.

10. Intellectual Property

The Service, including all software, text, graphics, logos, icons, and design, is the exclusive property of Zynaty Technologies (OPC) Private Limited or its licensors and is protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use KidMoat solely for personal, non-commercial parental-control purposes, subject to these Terms.

All feedback or suggestions you provide may be used by us without obligation to you.

11. Disclaimers

  • The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • KidMoat is a parenting aid, not a substitute for parental supervision. We make no guarantee that the Service will detect or prevent every harmful activity, app, or website your child may encounter.
  • Monitoring features depend on device-level permissions, OEM customisations, OS updates, and network connectivity. We do not guarantee uninterrupted or error-free operation.
  • We are not responsible for content, services, or links provided by third parties referenced from the Service.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Zynaty, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Service.

In no event shall our aggregate liability for any claims arising out of or related to the Service exceed the subscription fees you have paid us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Zynaty, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Service; (b) your breach of these Terms; (c) your violation of applicable law; or (d) your infringement of any third-party right, including the right to privacy of any individual monitored without lawful authority.

14. Termination

We may suspend or terminate your account, with or without notice, if we reasonably believe that you have violated these Terms. We will terminate accounts used to surveil adults without consent, for stalking, or for any unlawful purpose. Upon termination, your right to use the Service ceases immediately, and your data will be handled in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Sections 10, 11, 12, 13, and 16) will so survive.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles. Subject to Section 16 (Arbitration), the courts at Kolkata, West Bengal, India shall have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service.

16. Dispute Resolution — Arbitration

Before initiating any formal proceeding, the parties agree to attempt resolution in good faith for at least 30 days, beginning when the complaining party gives written notice to kidmoat@gmail.com.

If the dispute is not resolved within that period, it shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India), by a sole arbitrator mutually appointed by the parties. The seat and venue of arbitration shall be Kolkata, West Bengal, India, and the language of arbitration shall be English. The arbitrator's award shall be final and binding on the parties.

If applicable consumer-protection law in your country gives you stronger rights than these Terms — including limits on jurisdiction, arbitration, or refunds — those rights apply, and these Terms do not override them.

17. Changes to These Terms

We may modify these Terms from time to time. For material changes we will provide at least 30 days' notice by email to the address associated with your account or by a prominent in-app notice. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.

18. General

  • Entire agreement: These Terms, together with the Privacy Policy and any plan-specific terms, are the entire agreement between you and Zynaty regarding the Service.
  • Severability: If any provision of these Terms is held unenforceable, the remaining provisions shall continue in full force.
  • No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign our rights and obligations to a successor in interest, including in connection with a merger, acquisition, or sale of assets.
  • Force majeure: Neither party is liable for failure to perform obligations affected by events beyond its reasonable control, including natural disasters, network outages, government action, or labour disputes.
